In September, Branch County Circuit Court sentenced a woman to 25 years to life in prison for one felony count of Conspiracy to Commit First Degree Criminal Sexual Conduct charge and one felony count of Conspiracy to Commit Kidnapping. She will also need to register as a sex offender for life. The conviction is part of a series of cases involving a child sex abuse conspiracy ring.
Why is this conviction so shocking for so many people? In our society, criminal sexual conduct typically brings to mind the image of a male perpetrator. Because of gender stereotypes and the average difference in size between men and women, many people mistakenly believe women do not (or cannot) commit sexual violence.
What Happens When Women Are Charged with Criminal Sexual Conduct?
According to recent studies, society’s perception of sex crime perpetrators is significantly flawed. Both men and women commit sex crimes, but female perpetrators are unresearched, underreported, and underrepresented. Despite vast improvements in gender equality, the topic of female child sexual offenders (FCSO) is still incredibly taboo.
Michigan’s Criminal Sexual Conduct Act (CSC Act) mandates equal treatment of male and female perpetrators. Theoretically, gender will not influence sentencing. Valid evidence, reliable testimony, and Michigan state law must guide the court to a fair resolution.
Unfortunately, gender biases affect not only the general public but also the legal professionals within a court of law. Society’s flawed perception and avoidance of the topic of FCSOs affect the outcomes of criminal cases, especially if defendants don’t have access to skilled representation. To combat this issue, experts emphasize the need for additional, thorough research in this area, as well as a legal system devoid of all gender bias.
