On being named a DBusiness Top Lawyer for 2019, Brian commented:
"I'm extremely honored. I've been lucky enough to have been recognized often for my work, and you'd think that after being in various publications and things like that, it would get old, or that I would lose my sense of appreciation. But it's the opposite - every time someone recognizes me for the work I put in and the results we get, I feel more grateful because these are the things that keep me going through those long all-nighters and countless revisions as I prepare every word that I will speak to my juries. Being named for DBusiness Top Lawyers also reminds me, however, that the real heroes are the great people I have working with me who do all of the little things. On why Brian J. Prain concentrates on defending those accused of violating Michigan Criminal Sexual Conduct laws, here's what Brian had to say:
"For me, defending CSC cases came to me sort of as a natural consequence of my personality, my makeup, and my work and preparation habits.
The way I see it, a Criminal Defense Attorney can spend his or her courier doing one of two basic types of cases, or some combination of both.
On the one hand, there are the attorneys I see running all around town handling many, many small cases – misdemeanor theft, drugs, retail fraud, drunk driving/DUI. These cases individually take a lot less effort than serious felony cases. I’ve heard of attorneys handling up to 100 of these cases at once, sometimes up to 150 if they are also taking court-appointed cases. Most of these cases result in a very quick plea deals, and there is very little trail work or trial advocacy involved, if at all. Of course, there are exceptions to this rule, and if that’s the law practice that they envision for themselves, and there’s absolutely nothing wrong with that. For them, it's a business, and that's fine. But it’s just not me…
I like to work for long, uninterrupted hours on a single case. I like to really sink my teeth in to one issue at a time and reach that peak focus. Criminal Sexual Conduct cases and other serious Assaultive crimes allow me to do that. My caseload at any given time is about 85% Criminal Sexual Conduct or higher. These cases are no joke – CSC charges are extremely serious. If you are accused of Criminal Sexual Conduct in Michigan, Prison time is a real possibility. Because CSC is so serious, we are usually either in trial or preparing for a jury trial. There are four main Degrees of Criminal Sexual Conduct in Michigan (First Degree CSC, Second Degree CSC, Third Degree CSC, and Fourth Degree CSC). It’s a whole different world. Because of the complexity of CSC cases, I only handle approximately 10 to 15 cases at one time. If you’re really doing your job, on each case, handling DNA evidence, expert witnesses, and other things, you can’t handle much more than that. I work around the clock. My attitude is, I AM NOT GOING TO LOSE. You cannot sustain a practice doing a bunch of little cases all at the same time and spending all day on the phone if you have my mentality.
I’m not saying that my way is either good or bad. I’m just saying that for whatever reason, I was built to handle the serious stuff. I thrive on taking on big challenges. Yes, it’s a very scary sometimes, but it compels me to the next level of excellence and that’s what I’m here for - to be the best trial lawyer in this country."
